Les sciences modernes ont prétendu s'affranchir des intérêts de tous ordres et faire sortir la subjectivité et la morale de l'arène scientifique pour donner à voir des vérités absolues. Lorraine Daston montre que, à l'inverse, tout le travail de l'historien des sciences consiste à restituer l'imbrication de la morale et de la science. Car, loin d'être désintéressé, l'homme de sciences est bel et bien animé par des principes de justification et des impératifs moraux, ce que l'auteure appelle une « économie morale de la science » : « économie », parce qu'on identifie des régularités, un système organisé ; « morale » parce qu'il s'agit de prendre en compte, dans le processus même de la recherche, les valeurs et affects du savant qui la mène. In eighteenth-century France, there were almost no theoretical evolutions in the judicial field. Yet, ways of judging differed between the beginning and the end of the century. This paper is based on a close reading of requests for royal pardon at two different moments, 1729 and 1775. Although the same judicial categories of Roman origin appear in both contexts, they are not used the same way. At the beginning of the century, most trials were initiated by the litigants, and the narratives deal mostly with the concrete event and its meaning in the social order. In 1775, the context was different: justice was more professional and less interested in the event itself than in the respect of a rule and in the person who trespassed it. The core of the judgment was at this point the intention and motives of the defendant. Shaping the international order according to the Union’s values is not just a political ambition, but is also enshrined in EU primary law in the form of the external objectives of the Union. These have been streamlined and expanded significantly with the Lisbon reform (above all Arts. 3(5) and 21 TEU). However, scholarship has not given these objectives an altogether warm welcome, often dismissing them as strange, superfluous or mere wishful thinking. The aim of this chapter is to put these external objectives into the wider context of the ‘dynamic internationalisation’ of constitutional law around the world and approach them as part of a constitutional norm category. It is argued that in contemporary constitutional law, externally-oriented objectives are not unusual, but indeed increasingly commonplace. Moreover, at least in German and French legal scholarship, constitutional objectives have received considerable attention and are acknowledged as legally binding, in principle justiciable norms of constitutional rank. This also applies to externally-oriented objectives, even though a wider margin of discretion pertains to the executive branch as the main actor in the area of foreign affairs. The emergence of a security and defence policy of the European Union (EU) and the questions it raises for the relationship between the Union and the North Atlantic Treaty Organization (NATO) have always been closely linked to the question of the ‘identity’ of the EU on the international stage. To (ab)use René Descartes’ famous axiom: Union bears arms, therefore it is – arma fero, ergo sum. The EU-NATO relationship is therefore particularly well suited for scrutinizing the Union’s ‘international identity’ through the interaction with another international organization. This paper argues that notwithstanding the mutual reaffirmations of importance between the two organisations, the European Union has not only come to incorporate security and defence policy into its ambit of competences, but has put itself on a track to become a fully-fledged security policy actor, arguably surpassing NATO. At the same time, the relevance of NATO has declined, and it is left with the choice either to branch out or accept a residual yet not insignificant role in transatlantic relations. The international role of the EU and its contribution to global governance have become formidable topics in international relations scholarship. However, evaluations of both differ widely. At the same time, the Lisbon Treaty has codified a range of objectives with a clear global governance dimension into the EU’s primary law. Among many other things, the Treaties now mandate the Union to expressly ‘promote an international system based on stronger multilateral cooperation and good global governance’. These objectives can be said to present the Union’s constitutionally stipulated ‘world view’, i.e. the kind of world to which the Treaties mandate the Union to contribute. This introduces a manifest, but thus far understudied, legal dimension of global governance. As we can see from the widely divergent assessments of the EU’s role in global governance and the international system in general, there is a need for dependable and justifiable benchmarks in this regard. It is argued here that constitutional foreign policy objectives represent an important—if not the most important—source for such benchmarks. A broad consensus exists within the literature on collective action that protest movements can have a multitude of important, intended, and unintended impacts on the establishment. There is, however, less agreement on how we can measure such effects, a problem that has clearly hindered systematic investigations in this important area of research. This chapter argues that the methodological question of how to study the impact of protest movements on the establishment leads to a much broader theoretical issue and to the main challenge facing researchers of social movement outcomes to date, namely, how to establish a link between movement activities and political, social, and cultural changes. The aim of this chapter is to stimulate theoretical and methodological reflections about how to study the effects of protest movements on the establishment. We do this by extending our field of analysis and focusing not only on the impacts on the establishment, but more broadly on the range of potential outcomes associated with collective action. Throughout this discussion particular attention will also be directed toward how, conversely, the establishment responds to protest. We refer to this response as the external political dimension of social movement outcomes.
