The author evaluates the effectiveness of policy measures adopted by Chile and Colombia, aiming to mitigate the deleterious effects of pro-cyclical capital flows. In the case of Chile, according to his Generalized Method of Moments (GMM) analysis, capital controls succeeded in reducing net short-term capital flows but did not affect long-term flows. As far as Colombia is concerned, the regulations were capable of affecting total flows and also long-term ones. In addition, the co-integration models indicate that the regulations did not have a direct effect on the real exchange rate in the Chilean case. Nonetheless, the model used for Colombia did detect a direct impact of the capital controls on the real exchange rate. Therefore, the results do not seem to support the idea that those regulations were easily evaded.

The results of the alpha survey on administrative barriers completed in 2006 indicate that, notwithstanding recent government reforms to reduce regulations affecting firms, administrative burdens are still substantial impediments to doing business. Based on the survey, the Bulgarian Government has commissioned an in-depth analysis of the procedure affecting three sectors: tourism, food, and transport. This report recommends the efficiency of inspections should be evaluated and a centralized inspection authority for foodstuffs and feed should be considered. More work is needed to assess the efficiency of the current inspection service.

The book consists of two papers which provide an overview of administrative barriers in Africa, and a very in-depth look at how one country, Mozambique, used a very large foreign investment as a mechanism to begin to tear them down. The first paper is based on a series of country-specific studies on administrative barriers done by Foreign Investment Advisory Service (FIAS) and the United States Agency for International Development. These studies covered Ghana, Mozambique, Namibia, Tanzania, and Uganda. Each country study relied on review of primary materials, laws, and regulations. The second paper is a detailed look at how the administrative barriers that existed in Mozambique threatened to derail the huge Mozal aluminum smelter that was proposed by South African investors. Not only were the barriers overcome for this special project but also the Government used the knowledge gained in the process to reduce barriers for all investors and establish institutions that could facilitate other investments. The message in both papers is that administrative barriers constitute a significant impediment to foreign direct investment in Africa. Many of the administrative procedures required of investors have no real justification. Removal of unnecessary barriers and streamlining other administrative procedures require detailed efforts by governments involving the exercise of significant political leadership.

The transition from a centrally planned economy to a "socialist oriented market economy" in Vietnam has called for comprehensive changes in the legal framework of the State. The last ten years have witnessed great progress in the development of the Vietnamese legal system, both in substantive and procedural matters. A number of important legal instruments have been promulgated, such as the Constitution in 1992; the Land Law in 1993; and the Civil Code in 1996. The authors use data from Ethiopia to empirically assess determinants of participation in land rental markets, compare these to those of administrative land reallocation, and make inferences on the likely impact of households' expectations regarding future redistribution. Results indicate that rental markets outperform administrative reallocation in terms of efficiency and poverty. Households who have part-time jobs in the off-farm sector are significantly more likely to expect land to be taken away from them through administrative means. Eliminating the scope for administrative land reallocation may thus be a precondition for more vigorous development of the off-farm sector.

As the Western Balkan economies look toward integration into the European Union, each is striving to increase its competitiveness and improve its economic growth. Considerable momentum has been developing on business enabling environment (BEE) reform. The overall doing business rankings for the countries in this region are in the third and fourth quartiles for 2009, showing plenty of room for improvement. Investors identified improvements in regulations affecting businesses as a key priority for upgrading the business enabling environment in the region. In this smart lesson, the author shares the experience of adapting the standard cost model to review regulations and measure impact in supporting BEE reforms at the subnational level in Bosnia and Herzegovina, Montenegro, and Serbia. Since 2001, the Afghan population's access to basic services has greatly improved in nearly all sectors. School enrolment has increased sharply, with over eight million children currently enrolled in school, of which 39 percent are girls. Current strategies for improving sub-national service delivery focus on delegating greater authority to provincial and district administrations. This report aims to identify administrative constraints in three key sectors of public service delivery, education, health and agricultural extension services. The present report on the Administrative and Regulatory Barriers to Business is part of an ongoing World Bank analytical and advisory support to the Government of Bulgaria in the area of regulatory reform. Public procurement legislation in Turkey has not kept pace with the sweeping reforms undertaken in the national procurement systems of many other countries during the same period nor with the development of internationally recognized bodies of procurement legislation, such as those of United Nations Commission on International Trade Law (UNCITRAL), the European Union (EU) and the World Trade Organization (WTO). Following Turkey's acceptance, in December 1999, as a candidate country for accession to the EU, the Government has committed itself to achieving approximation and, eventually, alignment with EU law in many areas, including public procurement. To that end, the MOF and MPWS have already begun the process of drafting a new public procurement law, a draft of which has already been promulgated within Government and on which both the World Bank and the European Commission have offered their comments. Informality is pervasive in many developing countries, where the majority of businesses do not register. One view, linked strongly with Hernando de Soto and the International Finance Corporations (IFC's) doing business project, is that the informal sector consists of potential entrepreneurs who remain small as the administrative and financial costs of becoming formal prevent firms from formalizing, but that formalization is needed to obtain access to finance, and have the incentive to grow without fear of government inspectors. Moreover, it is often argued further that the burden of regulation is even larger for female business owners, because they have less time and money to overcome expensive and time-consuming barriers to registration. The main challenge of the transition has been to redefine how the state interacts with firms, but little attention has been paid to the flip side of the relationship : how firms influence the state - especially how they exert influence on, and collude with public officials to extract advantages. Some firms in transition economies have been able to shape the rules of the game to their own advantage, at considerable social cost, creating what the authors call a "capture economy" in many countries. In the capture economy, public officials, and politicians privately sell under-provided public goods, and a range of rent-generating advantages "a la carte" to individual firms. Transitional provisions are defined as the set of regulations that rule juridical relationships on the occasion of a legislative change. Out of this context of law succession, their indiscriminate application can lead to serious inconsistencies. The analysis of a Spanish private law example is offered to illustrate this fact. It concerns the administrative authorization for the demolition of rented buildings in the cities. A regulation repealed more than fifteen years ago and however widespread utilised on ancient constructions that, after recent urban development, have acquired great economic value; something that in the end explains the current importance of such provisions. The Doing Business data highlight the important role of the government and government policies in the day-to-day life of domestic small and medium-size firms. The objective is to encourage regulations that are designed to be efficient, accessible to all who use them and simple in their implementation. Where regulation is burdensome and competition limited, success tends to depend on whom one knows. But where regulation is efficient, transparent and implemented in a simple way, it becomes easier for aspiring entrepreneurs to compete on an equal footing and to innovate and expand. In this sense Doing Business values good rules as a key to social inclusion.
